What is the minimum notice period for a New York civil motion?
Under CPLR 2214, a notice of motion must be served at least 8 days before the return date. If the motion is based on an order to show cause, the timing is set by the court in the order. Cross-motions are due 3 days before the return date.
Can motion papers be served by mail instead of personal service?
CPLR 2103 permits service of motion papers by mail if the receiving party has appeared in the action. Mail service adds 5 days to the notice period. Personal service by a process server is faster and produces a cleaner proof of service.
